These Terms of Service ("Terms") apply to all visitors and customers of Southernwind, an online clothing store based in Switzerland. By placing an order or using our website, you confirm that you have read, understood, and agree to these Terms. These Terms are governed by Swiss law, in particular the Swiss Code of Obligations (CO/OR).

2. Products and Availability

All products are subject to availability. We reserve the right to limit quantities or discontinue products at any time. Product images and descriptions are provided in good faith and are as accurate as reasonably possible. Minor variations in colour may occur due to screen settings.

3. Pricing and Payment

All prices are listed in Swiss Francs (CHF) and include applicable Swiss VAT. We reserve the right to change prices at any time without prior notice. We accept Visa, Mastercard, PayPal, and American Express. Payment is processed at the time of order. We use secure, encrypted payment processing and do not store card details.

4. Order Confirmation and Contract Formation

A contract between you and Southernwind is formed when we send you an order confirmation email. We reserve the right to cancel an order prior to dispatch if a product becomes unavailable or if payment cannot be processed.

5. Shipping and Delivery

We ship from Switzerland. Estimated delivery times are: Switzerland 2-4 business days, EU 5-10 business days, Worldwide 7-21 business days. These are estimates only. We are not responsible for delays caused by customs, postal services, or circumstances outside our control. Shipping costs are calculated at checkout.

6. Warranty (Swiss CO Art. 197ff.)

Under Swiss consumer protection law, we provide a statutory 2-year warranty on all products against material defects existing at the time of delivery. If a defect is discovered, please contact us within the warranty period. We will repair, replace, or refund the product at our discretion.

7. Returns and Refunds

In addition to your statutory rights, we voluntarily offer a 30-day money-back guarantee. Please refer to our Refund Policy for full details.

8. Intellectual Property

All content on this website — including images, text, logos, and designs — is the intellectual property of Southernwind and may not be reproduced, distributed, or used without our written permission.

9. Limitation of Liability

To the extent permitted by Swiss law, our total liability to you shall not exceed the value of your order. We shall not be liable for indirect, consequential, or special damages. Nothing in these Terms limits our liability for death or personal injury caused by negligence, or for any other liability that cannot be excluded under Swiss law.

10. Governing Law and Jurisdiction

These Terms are governed exclusively by Swiss law. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Switzerland, subject to mandatory provisions of Swiss consumer protection law.

11. Changes to These Terms

We reserve the right to amend these Terms at any time. The current version is always available on our website. Continued use of the website after changes constitutes acceptance of the updated Terms.
